JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Dulhin Bajar P.S. Case No. 300 of 2017, registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
Allegation against the accused persons, including the petitioner is of assaulting the deceased and causing his death. Submission of learned counsel for the petitioner is that there is general and omnibus allegation against the petitioner of assault and police after investigation submitted final form finding case not true and considering the same several co-accused persons have been granted privilege of anticipatory bail either by this Court or by co-ordinate Benches of this Court vide order dated 20.2.2019 in Cr.Misc.No. 119 of 2019, vide order dated 20.4.2018 in Cr.Misc.No. 20380 of 2018,
Patna High Court CR. MISC. No.7219 of 2019(3) dt.04-04-2019 2/2 vide order dated 11.4.2018 in Cr.Misc.No. 16779 of 2018 and vide order dated 29.3.2019 passed in Cr.Misc.No. 17567 of 2019.

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Danapur, Dist. Patna, in connection with Dulhin Bajar P.S. Case No. 300 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
