Petitioner apprehends arrest in a case registered for the offence punishable under sections 7(i) (a)(i) and 7 (I) (a)(ii) of E.C. Act 1955 of the Indian Penal Code.

It is alleged that the petitioner was involved in blackmarketing of fertilizer and on inspection 1897 Urea bags, 65 cartoon bags fertilizer and a tractor were recovered and seized. It is submitted by the learned counsel for the petitioner that petitioner is license holder of fertilizer. He has taken godown on rent to keep his stock safe. He further submits that due to non-fulfillment of illegal gratification to the informant, this false and fabricated case has been lodged against

Patna High Court CR. MISC. No.8753 of 2023(2) dt.12-05-2023 2/2 this petitioner. Petitioner claims clean antecedent. Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M Motihari East Champaran in connection with Turkauliya (Banjariya) P.S. case no 766 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
