The petitioner is languishing in custody since 01.04.2014 in a case registered for the offences punishable under Sections 20 and 22 of the NDPS Act.

Twenty kgs. of Ganja was recovered from the petitioner.

It is submitted by learned counsel for the petitioner that the weight of seized contraband was assessed on speculative basis. The petitioner was not present in the house at the time of seizure and petitioner has no criminal antecedent. Considering the recovery of commercial

Patna High Court Cr.Misc. No.29283 of 2014 (04) dt.04-03-2015 2/2 quantity, this Court is not inclined to grant bail to the petitioner in connection with NDPS Case No. 122 of 2013 arising out of Ghorasahan (Jitna) P.S. Case No. 308 of 2013 pending in the court of learned Special Judge, NDPS, East Champaran. Accordingly, the prayer for bail of the petitioner is rejected.
