JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 31-01-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with N.D.P.S. Case No. 25 of 2018 arising out of N.C.B. Case No. NCB/PZU/V/25/2018 for the offenses under Sections 8 and 20 (b)(ii)(c) of the N.D.P.S. Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. Total 8.500 kg of Charas was seized. He is in custody since 07.05.2018. Considering the fact that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 2,00,000/-(Two Lakhs) with two

No.3910 of 2020(2) dt.31-01-2020 2/2 sureties of the like amount each to the satisfaction of the Sessions Judge-cum-Special Judge, East Champaran, Motihari in connection with N.D.P.S. Case No. 25 of 2018 arising out of N.C.B. Case No. NCB/PZU/V/25/2018, subject to the following conditions:- (a) The petitioner shall deposit Rs. 5,00,000/- cash in the Court below and produce receipt showing payment thereof at the time of submission of bail bond.

(b) The Court below is directed to expedite the trial of the case and conclude the trial on day to day basis within a maximum period of three months from today.

(c) In the event there is any dilly-dally attributable to the petitioner, the Court below shall be at liberty to cancel his bail bonds, and (d) Deposit of Rs. 5,00,000/- cash shall abide by the final outcome of the case.
