After some argument learned counsel for the petitioner wants to withdraw the prayer for bail with liberty to file the regular bail application.

Prayer is allowed.

The petitioner is directed to surrender in the Court of Sri P.K. Choudhary, J.M. Saran at Chapra in connection with Excise Case No. 28 of 2013/ Trial No. 3633 of 2014 and seek regular bail, then in that case considering the quantity of recovery regular bail shall be considered on the same day without being prejudiced by the order of this Court.

Accordingly, this criminal miscellaneous application is disposed of.
