JUSTICE SUDHIR SINGH ORAL ORDER 22-11-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with a case registered under Sections 384, 436 and 307 of the Indian Penal Code.

It is alleged by the informant that 4-5 days earlier from 12.9.15, the petitioner had demanded Rs. 20,000/- as rangdari from his son and if the said money is not given on 11.9.2015 he fired his son and opened the shutter at 11.15 P.M and when his son tried to lit up the fire and opened the shutter, the petitioner pushed his son from his back in fire, resulting his son badly injured. It has been submitted on behalf of the petitioner that the petitioner is in custody since 13.10.2015. Charge sheet has been submitted in this case. He has falsely been implicated in the

Patna High Court Cr.Misc. No.19600 of 2016 (5) dt.22-11-2016 2/2 present case. There is no allegation of tampering with the witnesses alleged against the petitioner. He has remained in custody for more than a year. Place of occurrence is the market place. There is no eye witness of the alleged occurrence. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarfpur in connection with Brahampura P.S.Case No.250 of 2015.
