JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-07-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Mohania Police Station Case No. 167 of 2015 registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

Petitioner no. 1 is father-in-law and petitioner no. 2 is mother-in-law whereas petitioner no. 3 is married sister -in-law of the deceased.

Annexure-3 to the petition reveals that the statement of deceased was recorded in the hospital on 22.04.2015 and in the

Patna High Court Cr.Misc. No.28541 of 2015 (2) dt.24-07-2015 2/2 aforesaid statement she specifically stated that she was caught in fire at the time of cooking meal.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabhua in Mohania Police Station Case No. 167 of 2015, subject to condition as laid down under Section 438(2) of the Cr.P.C.
