Petitioner is not named in the first information report and as per submission on behalf of the petitioner; name of the petitioner came in this case in supervision note of the Dy. S.P. Moreover, there is specific allegation against FIR named accused persons and, therefore, even if, it is assumed that petitioner participated in the alleged crime, then also, petitioner is said to be a member of unlawful assembly only.
