In this case, the petitioner is seeking anticipatory bail in connection with Wazirganj P.S. Case No.131 of 2018, registered for the offence punishable under Sections 341 and 302/34 of the Indian Penal Code and under Section 27 of the Arms Act.

Allegation has been made that one Manoj Kumar has resorted to firing upon the husband of the informant. Further allegation has been made that the present petitioner was also along with said Manoj Kumar.

Learned counsel for the petitioner submits that in first case vide Wazirganj P.S. Case No. 441 of 2017 the petitioner has been made an accused by his name, but in the

Patna High Court Cr.Misc. No.4574 of 2019(2) dt.29-01-2019 2/2 present case, same informant has taken his name by giving relationship of Manoj Kumar.

Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
