ANJANA PRAKASH ORAL ORDER 29-07-2015 Heard learned Counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Sections 307, 353/34 of the Indian Penal Code and Section 27 of the Arms Act.

Considering that the Petitioner undertakes to be physically present on each date of trial, let the petitioner above named, be released on bail on furnishing bail bond of Rs.5,000/- (Five thousand) with two sureties of the like amount each or any other surety to be fixed by the court concerned to the satisfaction of learned 2nd Additional Sessions Judge, Bagaha, Distt. West Champaran, in connection with Naurangia P.S. Case No. 14 of 1997, subject to the conditions, (i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving

The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner. (ii) That the Petitioner will be physically present on each date of trial and if he fails to do so on two consecutive dates without any reasonable cause, his bail shall stand automatically cancelled.

The Trial Court is directed to conclude the Trial expeditiously for which reason, he is directed to send a list of the witnesses fixing specific dates for production of the witnesses along with a copy of this order in connection with Sessions Trial No. 180 of 2004 arising out of Naurangia P.S. Case No. 14 of 1997, to the Superintendent of Police, West Champaran, and the Superintendent of Police, West Champaran, is directed to ensure production of the witnesses on the date so fixed by the Trial Court so that there is no further delay in trial.
