2. The petitioner seeks regular bail in connection with B.P Case No. 2860/2023 in connection with Chhatauni P.S. Case No. 545/2023 registered on 31.10.2023 lodged under Sections 341, 327, 307 and 379/34 of the I.P.C.

3. As per the prosecution case, F.I.R. has been lodged against one named and 3-4 unknown accused persons against whom there is allegation that they have surrounded the informant and at the gun point tried to snatch E-rickshaw and cash of Rs. 50,000/- and gold chain and while opposing they gave knife blow to the informant.

4. Counsel for the petitioner submits that petitioner and informant are resident of the same village and well know to

Thereafter, case and counter case has been lodged for the same date and same police station i.e. Chhatauni P.S. Case No. 545 of 2023 by the informant side and Chhatauni P.S. Case No. 544 of 2023 from the petitioner side. Counsel further submits that injury report has been annexed of both the side and it transpires that one serious injury has been cause from both the side.

5. Counsel further submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 16.11.2023 having one criminal case pending against him, in which he is on bail.

6. Learned counsel for the State opposes the prayer for bail.

7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail after framing of charge and on being satisfied by the trial Court that petitioner is not absconding in another case i.e. Chhatauni P.S. Case No. 176 of 2015 and on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.
