JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 The petitioner seeks regular bail in connection with Belaganj P.S. Case No. 408 of 2019, registered for offences punishable under Sections 419, 420, 379 of the Indian Penal Code and Sections 36(AC), 27(b)(ii), 28, 28(A) of the Drugs and Cosmetic Act, 1940 amended Act, 2008.

Allegation is of recovery of 190 items of drug from the medicine shop of the petitioner and it is alleged that he was running the said medical shop without having license. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and he is only the employee of the said medical shop and its owner is one Md. Safique. Further submission is that he has no criminal antecedent he has been in judicial custody since 02.12.2019.

Having heard both sides, in view of the above submissions, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -XI, Gaya, in connection with Belaganj P.S. Case No. 408 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
