JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report and it is alleged that petitioner and other F.I.R named accused made indiscriminate firing on the informant. There is specific allegation that it was co-accused Chhabilal Yadav, who shot fire on the temple of the informant. The informant appears to have sustained altogether five injuries, out of which two injuries are said to be grievous in nature whereas three injuries are simple in nature. The injuries found on scapular region as well as left temporal region of face were categories as grievous injuries but it is not specific who caused the aforesaid injuries. Moreover, co-accused Chhabilal Yadav and Sintu Mehra have already been granted privilege of
Patna High Court Cr.Misc. No.19094 of 2016 (2) dt.05-05-2016 2/2 bail by a co-ordinate Bench of this Court.
Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Udakishunganj, Madhepura in connection with Bihariganj P.S.Case No. 123 of 2014.
