JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-03-2019 Petitioner seeks bail in anticipation of his arrest in connection with Chautham P.S. Case No. 48 of 2018, G.R. No. 662 of 2018, registered for the offences punishable under Sections 406, 409, 420, 468, 471 and 34 of the Indian Penal Code.

Allegation as per FIR is that under B.R.G.F. Scheme of installation of solar light and tube well several irregularities were found and for that petitioner and other accused persons were found to be responsible.

Submission of learned counsel for the petitioner is that though there is allegation against the petitioner is of committing irregularity in purchasing of solar light and he is accused in two other cases of similar type but no specific allegation has been attributed against him and he is still ready to

Having heard both sides and in the facts and circumstances, as stated above, this application is disposed of with a direction to the petitioner to surrender before the court below within a period of six weeks from the receipt of this order and on surrender he shall be released on provisional bail till submission of charge sheet with condition that he will cooperate with the investigating officer. However, after investigation if charge sheet is submitted against the petitioner, he has to surrender and make prayer for regular bail, which shall be considered on the basis of materials available on record at that stage.
