JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-04-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 353/379 and other ancillary sections of the Indian Penal Code and sections 37, 45 and 75(2) of the Bihar Prohibition and Excise Act. Prosecution case is that all the 14 FIR named accused persons including this petitioner and 8 to 10 unknown persons, in an inebriated condition, created obstruction in discharge of police party and got released two accused persons from the custody of the police. They also took away motorcycle of the police men.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Incident is alleged to have taken place at night and only on the identification of the chaukidar, petitioner has been roped in

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Exclusive Special Judge Excise II, Araria in Special Case No. 1074 of 2018, Sikti Police Station Case No. 151 of 2018, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
