The petitioner seeks bail in a case for the offences punishable under sections 409, 406 and 420 of the I.P.C The prosecution story, in brief, is that the accused persons including the petitioner has misappropriated money of Cooperative, credit Swablamabbi Sahkari Samiti Ltd. and thus created difficulties in payment of the creditors. On behalf of the petitioner it has been submitted that the petitioner is in custody since 10.11.2015. Charge sheet has been submitted in the case and the petitioner has got no criminal antecedent. It is further submitted that the petitioner is ready to deposit the amount of Rupees one lakh in the court below which

Patna High Court Cr.Misc. No.27109 of 2015 (2) dt.28-07-2015 2/2 shall be subject to the final disposal of the case. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

In the facts and circumstances as stated above, the petitioner is directed to deposit the amount of Rupees one lakh in the court below which shall be subject to final disposal of the case. The said amount will be deposited within a period of four months in the court below and in the meantime the petitioner shall be released on provisional bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Sitamarhi in Dumra P.S. Case No. 07 of 2014.

After the entire amount is deposited the provisional bail of the petitioner shall be confirmed by the court below itself. (Sudhir Singh, J) Abhay/- U T
