====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-05-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in a case registered for the offence punishable under Section 380 of the Indian Penal Code.

As per F.I.R., this petitioner along with one other coaccused person fled away with the ornament of the informant. Learned counsel appearing for the petitioner submits that the petitioner is innocent. As a matter of fact, father of the co-accused is a Carpenter and did some work in the house of the informant and when this petitioner went there to demand money, on behalf of his father, informant falsely implicated them in the present case. Moreover, no stolen article has been recovered from possession of the petitioner. Petitioner has got clean

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate- 7th, Bhojpur at Ara in connection with Ara (M) P. S. Case No. 313 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
