JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-B)A, 26, 35 of the Arms Act. Petitioner is said to have been caught along with four persons when they as well as some others had assembled to make preparation for committing dacoity but according to prosecution case itself, nothing was recovered from conscious possession of the petitioner though it is alleged that firearms and cartridges were recovered from possession of other co-accused. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 04.03.2016.
