The petitioner is languishing in custody since 14.4.2018 in a case registered for the offences punishable under Sections 399,402 and 414 of the I.P.C. and Sections 25(1-B)a,26 and 35 of the Arms Act.

The prosecution case as per the self statement of SI Sudhir Kumar, SHO, Banjariya Police Station recorded on 12.4.2018 at 11.45 P.M. is to the effect that on the same day at 9.05 P.M., the informant received a secret information that some miscreants have gathered in an orchard situated in the premises of Cambridge International Academy school, Banjariya and they are planning to commit dacoity, whereupon a raid was laid and six persons were apprehended including the petitioner. It is submitted by learned counsel for the petitioner that the investigation has already been concluded and the petitioner has remained in custody for more than nine months. It is further submitted that though the petitioner is accused in two other cases but he is on bail in those cases.

Considering the nature of recovery and the period under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned JM Ist Class, Sadar, Motihari in connection with Turkauliya (Banjariya) P.S.
