The petitioner is languishing in custody since 18.04.2015 in a case registered for the offences punishable under Sections 366A/34 of the Indian Penal Code and 3(1) (x) of SC/ST (Prevention of Atrocities) Act.
The accusation is of enticing away the minor daughter of the informant.
It is submitted by learned counsel for the petitioner that in 164 Cr.P.C. statement the victim got her age recorded as 14 years when the court has assessed as such but as per the medical opinion she was found 18 1⁄2 years. It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.27148 of 2015 (2) dt.31-07-2015 2/2 petitioner that the victim she of her own married with the petitioner as she was in love with the petitioner from before. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Sherghatty, Gaya in connection with Barachatty (Mohanpur) P.S. Case No. 574 of 2013.
