The petitioner is accused in connection with Kharagpur P.S. Case No. 122 of 2015, registered under Sections 341, 323, 307, 302, 201/34 of the Indian Penal Code. The accusation is that six named persons in the F.I.R. including the petitioner caused assault on 16.05.2015 to the informant and her husband as they went to grab the land on which the house of informant is situated. Since, all are the relative due to that reason, the case was not filed. On 16.05.2015, in the night, Bablu Mandal, Pappu Mandal, Pintu Kumar and Mithu Kumar came at the house of the informant and accompanied her husband at that time she was in the impression that her husband was taken by them for panchayati, but her
Patna High Court Cr.Misc. No.19553 of 2016 (2) dt.09-05-2016 2/2 husband did not return. On search, the dead body of her husband found in the water behind the Domsi bridge.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. the allegation against the petitioner and others was of causing assault due to land dispute earlier. There are specific allegation against others, namely, Bablu Mandal, Pappu Mandal, Pintu Kumar and Mithu Kumar, who accompanied the husband of the informant thereafter, his dead body is said to be recovered near Domsi bridge. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger in connection with Kharagpur P.S.
