The petitioner is languishing in custody since 01.11.2018 in a case registered for the offences punishable under Section 290 of the Indian Penal Code and Sections 5(c) (d)/7/8(B)(c) of the Prevention of Immoral Traffic Act. The prosecution case as per the written report of Sujata Rai, A.S.I. of Kotwali Police Station, Patna dated 30.10.2018 is to the effect that that on 30.10.2018 at 10.00 P.M. information was received by the informant that the ladies standing near G.P.O. Golambar are seducing and soliciting people for immoral trafficking, whereupon, the informant along with police personnel went to the spot and one apprehended one

Patna High Court Cr.Misc. No.5709 of 2019(2) dt.01-02-2019 2/2 lady, who disclosed her name as Pooja Devi @ Rekha Devi, the petitioner, who also confessed about the occurrence. It is submitted by learned counsel for the petitioner that the petitioner has falsely been roped in the present case and none complained about the petitioner being involve in any manner in the immoral trafficking. Though, the petitioner is accused in one another case but she is on bail in that case. Learned APP submits that the accusation is specific against the petitioner.

Considering the nature of accusation and the investigation has already been concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna in connection with Patna Kotwali P.S. Case No. 755 of 2018.
