Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Ara Muffasil P.S. Case No.434 of 2022 dated 16.12.2022 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise (Amendment) Act, 2018. 3.

The main submissions advanced by the learned counsel for the petitioner are that the instant matter relates to recovery of 30 litres of country-made liquor which is stated to have been recovered from the possession of this petitioner but from the perusal of the FIR it is clearly evident that the said wine was not recovered from the physical possession of this petitioner and the petitioner has fair and clean antecedent and has been languishing in jail since 17.12.2022

Patna High Court CR. MISC. No.6748 of 2023(2) dt.29-04-2023 2/2 and against him the investigation has been completed. 4.

Learned APP appearing for the State has opposed the bail prayer.

Considering the above submissions and mainly petitioner's fair and clean antecedent and the completion of investigation against him, in the opinion of this Court a lenient approach can be taken in respect of the petitioner's prayer, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Ara Muffasil P.S.
