JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 341,323,325,307 and 504/34 of the Indian Penal Code. It is alleged that the petitioner and co accused Sukhdeo Verma badly assaulted the informant.
It is submitted by the learned counsel for the petitioner that the petitioner is own brother of the informant and for petty dispute the occurrence took place though out of seven injuries four injuries have been found to be simple but with regard to three injuries opinion has been kept reserved. The petitioner has brought on record compromise petition filed before the learned court below (Annexure 3). Statement has been made in paragraph 3 of
Patna High Court Cr.Misc. No.28339 of 2015 (2) dt.23-07-2015 2/2 the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with Fatehpur P.S. Case No. 380 of 2014 pending in the court of learned CJM, Gaya.
This application is disposed of with the aforesaid observation/direction.
