The petitioners seek bail in Sonbarsa P.S. Case No. 03 of 2014, registered for the offence punishable under Section 394 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioners are not named in the FIR. For the first time name of the
Patna High Court Cr.Misc. No.18390 of 2015 (2) dt.15-06-2015 2/2 petitioners figured in the case in the statement of Chandan Kumar who is said to have disclosed that the petitioners were talking each other. The petitioners were not put on test identification parade. Nothing has been recovered from the possession of the petitioners. Similarly situated co-accused Dhirendra Kumar Singh @ Dhiru has already been enlarged on bail.
Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in Sonbarsa P.S.
