JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 31-07-2017 Inter alia, contending that there is encroachment in Government land bearing Khata No. 271, Kheshra No. 411, Thana No. 65 Mauza- Chamardih measuring 60 decimals situated in Fatuha within the jurisdiction of respondent No. 4, this writ application in public interest seeking removal of the encroachment has been field.
We find that the Circle Officer is already seized of the matter as is evident from Annexure-2 dated 22.9.2016. That being so, we direct that on the petitioner's filing a certified copy of this order along with a detailed application indicating actions for
Patna High Court CWJC No.9505 of 2017 (2) dt.31-07-2017 2/2 removal of the encroachment, the respondent No. 4 shall exercise his jurisdiction under the Bihar Public Land Encroachment Act and take steps for removal of the encroachment in accordance with law within a period of six months.
With the aforesaid, the writ application stands disposed of.
