Petitioners apprehend their arrest in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code.

The accusation in the F.I.R is that while informant was sitting at her house along with her deceased husband, all the accused persons including these petitioners arrived there. The informant was dragged by one Radha Devi whereafter the petitioner along with his wife strangulated the deceased in presence of the informant.

Learned counsel for the petitioners submits that deceased has actually committed suicide and taking advantage

Patna High Court CR. MISC. No.9178 of 2023(2) dt.25-04-2023 2/2 of death and also due to pending land dispute between the parties, petitioners have falsely been implicated in this case. Police after investigation submitted the final form in favour of the petitioners. Petitioners are ladies.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Jhanjharpur, District Madhubani in connection with Laukaha P.S. Case No. 127 of 2020, corresponding G.R. No. 670 of 2020 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
