The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 419 and 420 of the Indian Penal Code.

As per the prosecution case, this petitioner mortgaged the ancestral property of informant and earned interest on it by giving it on lease.

It is submitted that both parties are close agnates and due to land dispute this false case has been lodged. As a matter of fact, wife of petitioner has lodged a case bearing Chautham PS Case No. 16 of 2019 against the informant and others. In this case, police after investigation submitted final form bearing Final Form/Report No. 32/19 dated 24.10.2019, but differing with the same learned court below took cognizance

Patna High Court CR. MISC. No.5217 of 2023(2) dt.09-05-2023 2/2 against the petitioner. Petitioner claims clean antecedent. Counsel for informant however vehemently opposed the prayer for bail.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Gogari (Paura) P.S. Case No. 73 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
