Petitioner being the husband of the informant is languishing in custody since 06.02.2016 in a case registered for the offences punishable under Sections 323, 498A, 504, 307 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
This is an application for misuse of bail. The petitioner was earlier granted bail by a Coordinate Bench (now retired) by this Court vide Cr. Misc. No. 53758 of 2007. The petitioner default since 13.07.2013.
Learned counsel for the petitioner submits that petitioner will appear on each and every date before the learned court below.
Considering the aforesaid facts, let the above
Patna High Court Cr.Misc. No.17434 of 2016 (2) dt.21-04-2016 named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional District & Sessions Judge, Bhagalpur in connection with Kotwali (Adampur) P.S. Case No. 628 of 2005.
Considering the criminal antecedent of the petitioner, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence if he defaults for two consecutive occasions.
