2. The instant petition has been filed by the petitioner for quashing the order dated 03.06.2017 passed by the court of learned Principal Judge, Family Court, Katihar in Matrimonial Case No. 301 of 2016.

3. Learned counsel for the petitioner submits that the matter has been transferred from the Court learned Principal Judge, Family Court, Katihar to the court of learned Principal Judge, Family Court, Bhagalpur Vide order dated 31.08.2022 passed in MJC No. 3976 of 2019 by this Court. Learned counsel further submits that he do not want to press his petition so far as relief made in the petition is concerned and would confine himself for issuance of directions to the court of learned Principal Judge, Family Court, Bhagalpur to dispose of the case

Patna High Court C.Misc. No.1282 of 2017(4) dt.22-03-2024 2/2 before it as expeditiously as possible. Since after receipt of the records at Family Court, Bhagalpur on 17.10.2022, respondent has been abstaining herself and has failed to produce evidence and the matter has been dragging for quite long time. The respondent is not at all interested in producing her witnesses.

Since the learned counsel for the petitioner has confined his prayer only for expeditious disposal of the matrimonial case pending before the court of learned Principal Judge, Family Court, Bhagalpur, I do not think there is any need to issue notice to the respondent and the matter is disposed of with direction to the learned Principal Judge, Family Court, Bhagalpur to dispose of the petition pending before it within six months from the date of receipt/production of a copy of this order.
