The petitioner in the present case is seeking regular bail in connection with Rupaspur P.S. Case No.267 of 2019 registered for the offence punishable under Section 394 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Learned counsel submits that nothing has been recovered from the conscious possession of the petitioner and his name has transpired in the confessional statement of the other co-accused. Learned APP has opposed the prayer for bail.
Considering the facts and circumstances of the case wherein there is recovery of the stolen gold ornament from the
Patna High Court CR. MISC. No.3733 of 2020(2) dt.21-01-2020 2/2 house of this petitioner and the petitioner has got criminal antecedent of similar nature as stated in paragraph 3 of the bail application, this Court is not inclined to grant regular bail to the petitioner at this stage. The prayer is refused. He may, however, renew his prayer for bail after a reasonable period.
