The petitioner has preferred this application for grant of regular bail in a case registered under section 302 and other sections of the Indian Penal Code.

As per allegations in the FIR, it is stated that over a dispute between the families it was decided that a panchayat will be held. However, as a result of conspiracy the seven named accused persons including the petitioner herein came and started to assault the informant and her family members brutally as a result of which the informant's husband and mother-in-law died.

It is submitted by learned counsel for the petitioner that the allegations as levelled in the FIR are false and

Patna High Court CR. MISC. No.15835 of 2021(2) dt.12-08-2021 2/2 concocted. The manner of occurrence is other than what has been narrated in the FIR. No overt act has been alleged against this petitioner who is a 70 year old lady having no criminal antecedent and is in custody since 24.5.2020. Investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody for over one year, the Court directs the petitioner to be enlarged on bail in connection with Chandradeep P.S. Case no. 74/2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate 1st, Jamui.
