JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 399/402 of the Indian Penal Code and 25(1-B)a/26/35 of the Arms Act, 4/5 of the Explosive Substance Act. Two country made bombs and mobile are said to have been recovered from conscious possession of the petitioner when he along with others was arrested by the informant. The fire arms were recovered from possession of associates of the petitioner. Petitioner does have criminal antecedent of one case, i.e., Kadwa P.S. Case No.68 of 2008 registered under Sections 395 and 397 of the I.P.C.

No.20002 of 2016 (2) dt.06-05-2016 2/2 Taking into consideration the above stated facts as well as submissions of the parties and also keeping in mind that petitioner is in jail custody since 21.11.2015 and the investigation against him appears to have already been completed, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Purnea in connection with Dagaruwa (Dagarua) P.S. Case No.245 of 2015.
