2. At the very outset, Mr. Vijay Kumar Singh, learned counsel for the petitioner submits that the petitioner's case is squarely covered by the judgment dated 09.05.2019 passed in C.W.J.C. No.9440 of 2016 (Annexure-15 to the writ application)

Patna High Court CWJC No.2107 of 2025(2) dt.10-02-2025 2/2 and the judgment dated 22.01.2016 passed in L.P.A. No.1491 of 2012 (Annexure-13 to the writ application). He further submits that the Bihar Litigation Policy clearly states that the State would follow the decision in similar circumstances and would not precipitate the litigation unnecessarily to burden the litigants.

3. In such view of the matter, the Vice-Chancellor of the Baba Saheb Bhim Rao Ambedkar Bihar University, Muzaffarpur is directed to consider the representation of the petitioner filed on 06.12.2024 (Annexure-P-9 to the writ application) in view of the decisions of this Court and the Hon'ble Apex Court within a period of one month from the date of receipt/production of a copy of this order.

4. Needless to state that this Court may take serious view of the matter, if this order is not complied within the stipulated period as aforesaid.

5. Accordingly, this writ application stands disposed of.
