In the present case, as per scheme of the Government, one Middle School of each Gram Panchayat has to be upgraded to the level of High School.

The petitioner, in this case, prays for a relief for upgradation of Middle School, Sihuli Khaira situated in Gram

Patna High Court CWJC No.153 of 2019 dt.02-09-2019 2/3 Panchayat Sihuli, District Aurangabad up to the level of High School.

During pendency of this writ application, the Middle School, Barauna has been chosen for up-gradation up to the level of High School.

Learned counsel for the petitioner submits that the Middle School, Sihuli Khaira is better located, well equipped and having better strength of students which is one of the criteria and qualification to be taken for up-gradation of the school to level of High School but, instead of Middle School, Sihuli Khaira, the Middle School, Barauna has been notified to be a High School. Learned counsel for the petitioner submits that altogether three Middle Schools are running in the said Gram Panchayat and the Middle School, Sihuli Khaira is the best located school which requires to be upgraded.

These are the matters lie within the domain of executive and they are the best persons to choose the best school to be declared as an upgraded school.

Learned counsel for the petitioner submits that he should be given liberty to approach to the appropriate authority to raise his grievance.
