The petitioner has preferred this application for grant of regular bail in a case registered under sections 414 and other sections of the Indian Penal Code and sections 30(a), 34 and 36 of the Bihar Prohibition and Excise Act, 2016. As per allegation in the F.I.R., 356.4 litres of liquor was recovered from the khalihan of Shiv Shankar Yadav and the petitioner and others were taken into custody. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the petitioner's possession. He has no concern with the alleged place of recovery nor with the seized liquor. He has no criminal antecedent and is in custody since 8.12.2020.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Excise Case no. 914 of 2020 (arising out of Durgawati P.S. Case no. 299 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Kaimur at Bhabua/Additional District and Sessions Judge-IIcum-Special Judge, Excise Act, Kaimur at Bhabua.
