JUSTICE SANDEEP KUMAR ORAL ORDER 16-05-2023 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners seek regular bail in connection with Palanwa P.S. Case No. 90 of 2021, registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 354 and 302 of the Indian Penal Code.

Learned counsel for the petitioners submit that the petitioners are innocent and falsely been implicated in this case. Petitioners have no criminal antecedent. There is case and counter case between the parties. Similarly situated accused persons have been granted regular bail in Cr. Misc. No. 57013 of 2023 vide order dated 09.11.2022 and anticipatory bail in Cr.

Patna High Court CR. MISC. No.6608 of 2023(2) dt.16-05-2023 2/2 Misc. No. 7881 of 2023 vide order dated 29.04.2023. Petitioners are in custody since 05.11.2022.

Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against the petitioner, his period of custody, this application is allowed. Let the petitioners, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Raxaul at Motihari, in connection with Palanwa P.S. Case No. 90/2021.
