One Hero Honda Splendor motorcycle was recovered from Verandah of the house of the petitioner and petitioner was arrested on the spot.

Submission on behalf of the petitioner is that nothing has been recovered from the house of the petitioner. Petitioner does not have any criminal antecedent. Moreover, even if the aforesaid recovery is assumed to be true, then also, it appears that petitioner was a bona fide purchaser.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner is in jail custody since 11.03.2016, let the petitioner,

Patna High Court Cr.Misc. No.20104 of 2016 (2) dt.09-05-2016 2/2 above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate,- VIII, Saran at Chapra in connection with Mashrakh P.S.case No. 84 of 2016.
