The petitioner seeks bail in connection with Patna Kotwali P.S. Case No.769 of 2015 registered under Sections 420/34 of the Indian Penal Code.

The prosecution case is that the informant Jaspreet Singh talked to his part-time Accountant, Sanjeev Agrawal, on his mobile phone that Rs.2,00,000-2,50,000/- as loan has to be paid by him and asked the solution. After few days, Sanjeev Agrawal talked him and asked that he is in contact with some persons who get the money doubled and disclosed the name of one person as Patel giving him his two mobile numbers for talk. No.19451 of 2016 (3) dt.13-07-2016 2/3 informant came to Patna and collected Rs.2,50,000/- from different shops which was due in connection with the business of his father and made contact with Patel on his mobile saying that he has come with money, who told him to meet at 10.00-11.00 A.M. Thereafter, Patel asked on mobile phone to the informant to talk to one Manish Kumar. The informant talked to Manish Kumar who called him at R. Block. The informant went at R. Block where two persons came and asked him to come near Accountant General Office, Bihar, Patna, where they demanded money on which the informant asked them to show the money. They told the informant to give the money first then they will give the money to him within 10 minutes and till that time, one man will remain with him.

The informant handed over the money to them, then they moved from there and one man was present there. When the informant tried to contact with both persons on mobile, their mobile was found switched off. The informant raised suspicion that he has been cheated, then he caught the person, who was present there and took him near the shop owner known to him and the police came there on information and apprehended that person, who disclosed his name Ram Ayodhya Rai (petitioner).

Patna High Court Cr.Misc. No.19451 of 2016 (3) dt.13-07-2016 3/3 informant and the petitioner having no criminal antecedent is in custody since 22.12.2015. Further submission is that the on investigation, the chargesheet has already been submitted against the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna, in connection with Patna Kotwali P.S. Case No.769 of 2015. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
