The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 149, 341, 323, 302 of the Indian Penal Code.

As per prosecution case, on the alleged date and time of occurrence, this petitioner alongwith co-accused pressed abdomen of mother-in-law of informant with legs and also assaulted her, as a result of which, mother-in-law of informant died.

It is submitted on behalf of petitioner that the allegation is general and omnibus and no specific overt act has been alleged against this petitioner.

However, learned A.P.P. for the State opposed the bail petition and submitted that there is specific allegation against

Patna High Court CR. MISC. No.5308 of 2023(2) dt.10-04-2023 2/2 this petitioner that he alongwith co-accused pressed the abdomen of deceased with legs, as a result of which, she died. It is further submitted that petitioner has got five criminal antecedent.

Considering the nature of allegation and criminal antecedent of petitioner, the prayer for anticipatory bail of petitioner is rejected.
