Petitioners apprehend arrest in connection with Special Case No. 3 of 2017 arising out of Patna Vigilance P.S.Case No. 1 of 2017 registered for the offence punishable under sections 420, 406, 409, 467, 468, 120B of the Indian Penal Code and section 13(2) read with Section 13(1) (c) (d) of the Prevention
Patna High Court Cr.Misc. No.28582 of 2017(4) dt.25-08-2017 2/3 of Corruption Act, 1988.
Learned counsels appearing for the petitioners submit that petitioners were only the member of the Empowered Standing Committee of Siwan Nagar Parishad and the entire purchase has been made by the Purchase Committee of the Parishad. Petitioners are no way concerned with the purchase of Solar Lights. It is further submitted that similarly situated co-accused has been granted bail by this court vide order dated 27.07.2017 passed in Cr. Misc. No. 24476 of 2017.
Considering the facts and circumstances of the case and the submissions of advanced on behalf of the parties, let the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Vigilance, North Bihar, Muzaffarpur in connection with Special Case No. 3 of 2017 arising out of Patna Vigilance P.S.Case No. 1 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
