The petitioner has preferred this application for grant of regular bail in a case registered under sections 328 and 392 of the Indian Penal Code.

As per allegations in the FIR, the informant who was the driver of the truck, was looted of the goods loaded on the truck by the four accused persons.

It is submitted by learned counsel for the petitioner that the FIR was registered against four unknown. The name of the petitioner transpired in course of investigation on the confessional statement of co-accused Dhiraj Singh. No incriminating article has been recovered from his possession nor

Patna High Court CR. MISC. No.15874 of 2021(2) dt.12-08-2021 2/2 has he been put on T.I Parade. It is submitted that besides the confessional statement of co-accused made before police, there is no other material against this petitioner. He is in custody since 7.9.2020.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court directs the petitioner to be enlarged on bail in connection with Dumariaghat P.S. Case no. 130 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Chief Judicial Magistrate, Motihari, East Champaran.
