The petitioner apprehends his arrest in connection with Dinara P.S. Case No. 206 of 2019 registered under Sections 147, 148, 149, 323, 307, 504 and 506 of the Indian Penal Code, 1860 and Section 27 of the Arms Act.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. There is general and omnibus allegation against the petitioner. Petitioner has no criminal history. Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that on perusal of the first information report and the injury report, it would be evident that there is direct allegation against the

Patna High Court CR. MISC. No.15880 of 2021(2) dt.25-01-2022 2/2 petitioner that he abused and shot a bullet on informant's nephew (Ashok Pandey) and also assaulted him by means of Farsa on his head. The injury report also corroborates the same. Hence, petitioner does not deserve to be enlarged on anticipatory bail.

Having considered the facts and circumstances of the case and submissions made on behalf of the parties, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer of the petitioner is rejected. utkarsh/- (Arvind Srivastava, J) U T
