2. The petitioner is in custody in connection with Buxar Industrial P.S. Case No. 156 of 2024 for the offence under Section 103 and 3(5) of the B.N.S. and section 27 of the Arms Act, lodged on 11.07.2024 by the informant Khalique Sah.

3. As per the prosecution story, the informant alleged that earlier his son Majahar Sah had a quarrel with Mumtaz Khan and Tarik Khan near Gandhi Setu and was threatened of dyer consequences. On the fateful day, they came and opened fire causing serious injury to his son, as he was to be taken to PMCH, Patna, died in Sadar Hospital, Buxar itself. This led to the F.I.R.

4. Though, learned counsel for the petitioner tried to submit before the Court that he has been falsely implicated and

Patna High Court CR. MISC. No.7473 of 2025(2) dt.19-03-2025 2/2 had no role to play in the matter. Learned APP has taken this Court to the F.I.R. to show that the specific allegation is there against the petitioner that he opened fire which proved fatal.

5. Taking into account the submissions put forward by the parties as also perusal of the F.I.R. it is clear that the petitioner opened fire which cause death.

6. In that background, the bail application stands rejected.
