The petitioners seek regular bail in connection with Nadi PS PR case no. 83 of 2018 registered for the offence punishable under Section 30(a) of Excise Act. The allegation is regarding recovery of 40 liters of illicit mahua liquor from near the bank of Sabalpur river. It is alleged that upon seeing the police, the petitioners had tried to flee away while they were apprehended.

The learned counsel for the petitioners has submitted that the petitioners have been falsely implicated in the present case. It is further submitted that as far as the petitioner no. 1 is concerned, he is having a fair antecedent barring one

Patna High Court Cr.Misc. No.3956 of 2019(2) dt.25-01-2019 2/2 case in which he is on bail whereas, the petitioner no. 2 is having a clean antecedent. It is further submitted that the petitioners are languishing in custody since 19.09.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners on regular bail.

Accordingly, the abovenamed petitioners are directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of Addl. Sessions Judgecum-Special Judge, Excise Act, Patna in connection with Nadi PS PR case no. 83 of 2018.
