Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 341, 323, 324, 353, 307,
Patna High Court CR. MISC. No.6732 of 2020(2) dt.01-10-2020 2/3 504, 506, 379/34 of the Indian Penal Code.
Informant who is Chowkidar of the village in his written complaint has alleged that on 11.09.2019 at about 11:00 am when he was wandering in his area then he got secret information that some persons are melting stolen cooper wire and when he reached the place, he found petitioners melting stolen cooper wire and when he asked what they were doing then they abused and assaulted him and also snatched his wrist watch and golden chain.
It has been submitted on behalf of the petitioners that they are innocent and have been falsely implicated in this case at the instance of the Chowkidar who is on inimical terms with the petitioners. Nothing has been recovered from the possession of petitioners or from the place of occurrence. Petitioners have got no criminal antecedent.
Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on anticipatory bail in the event of their arrest or surrender before the court below within a period of four weeks from today upon furnishing bail bonds of Rs. 20,000/- each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Bettiah (Muffasil) P.S.
