JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-03-2022 Heard learned counsel for the petitioner and the State. Prayer for bail of this petitioner was earlier rejected by this court vide order dated 22.06.2021 passed in Cr. Misc. No. 5107/2021.

It is submitted that during trial the informant, Raushan Kumar Singh, and the victim, Brajesh Kumar Singh, in their deposition have not deposed anything against this petitioner and they have stated that they could not identify the assailant as there was complete dark and there was no provision of light. Petitioner is in custody since 08.07.2020.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case, deposition of the

No.5495 of 2022(2) dt.09-03-2022 2/2 informant and the victim and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IX, Buxar in connection with Buxar (Industrial) PS case No.142/2019.
