2. The petitioner seeks bail in connection with Charka Pathar P.S. Case No. 72 of 2025 registered for the offence punishable under Sections 80(2), 238, 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The petitioner is the brother-in-law (Devar) of the deceased. He is alleged to have participated in the killing of the deceased who is the sister of the informant on account of nonfulfillment of demand of dowry.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that the petitioner, being the Devar of the deceased has no role to play in the alleged crime and there

Patna High Court CR. MISC. No.7128 of 2026(3) dt.12-05-2026 2/2 is general and omnibus allegation against him. Learned counsel further submits that father-in-law of the deceased was granted bail by this Court vide order dated 22.12.2025 passed in Cr. Misc. No. 81892 of 2025.

5. Considering the general and omnibus allegation and the fact that the petitioner is a junior member of the family, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Jamui/ concerned Court in connection with Charka Pathar P.S. Case No. 72 of 2025, subject to the condition that the petitioner will co-operate in trial.

7. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not express any opinion on the merits of the case.
