JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, the father of deceased claimed that petitioner had illicit relation with one Baby Devi, the deceased was tenant of the aforesaid Baby Devi and petitioner as well as Baby Devi was pressurized the deceased to solemnize his marriage with the daughter of Baby Devi but when the deceased refused to marry, petitioner as well as Baby Devi allegedly committed murder of the deceased.

Admittedly, none has seen the actual killing of the deceased and except the aforesaid material there appears to be nothing against the petitioner.

Patna High Court Cr.Misc. No.26989 of 2014 (3) dt.12-01-2015 2/2 Accordingly, above named petitioner is directed to be released on bail, on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Dalsingsarai, Samastipur in connection with Dalsingsarai P.S.Case No. 65 of 2014.
