JUSTICE BIRENDRA KUMAR ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468, 471 and 120B of the Indian Penal Code. The petitioner was Mukhiya and member of the appointment committee. Allegation is that certain teachers were appointed on the basis of forged educational certificate. Submission of the learned counsel for the petitioner is that at the stage of recruitment, the certificates produced by the candidates are taken into consideration and subsequently they are verified from the issuing authority. One of the candidates Ankita Bharati, whose certificate was found genuine on

Patna High Court Cr.Misc. No.33358 of 2017 (3) dt.19-08-2017 2/2 verification and the co-accused of this case, has already been allowed anticipatory bail by a Coordinate Bench of this Court in Cr. Misc. No. 25160 of 2017 on 26.07.2017.

Considering the aforesaid facts, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal/successor Court in connection with Arwal Police Station Case No. 242 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
